Equestrian Preserve Rules and Regulations
Cinnabar Equestrian Operations (CEO) has established the following rules and regulations for the Coto Equestrian Preserve, which are subject to review and modification from time to time.
The Equestrian Preserve is a private facility intended for the use and enjoyment of Boarders and their guests.
(a) The hours of use shall be from 7 a.m. – 10 p.m. daily, or as posted.
(b) Before riding or handling any horse at the Equestrian Preserve, all guests of Boarders must sign the release form located outside the Equestrian Preserve Office and deposit the signed release form in the mailbox located outside the door to the Equestrian Preserve Office.
(c) Guests must be accompanied by Boarder at all times, and it is the responsibility of Boarder to be sure that his or her guests have signed and provided to CEO the Release form referred to in section 1(b) above.
(d) Student guests may use the facility only in the capacity as a student under the supervision of a trainer authorized to provide such services at the Equestrian Preserve, and all student guests must sign and deliver to CEO the Release form provided by the trainer whom lessons will be given by.
To the extent possible, reasonable and practical, available stalls/pipe corrals at the Equestrian Preserve facility will first be offered to current Boarders and trainers. CEO does not guarantee or warrant that any particular stall/pipe corral at the Equestrian Preserve facility will be reserved or preserved for anyone. CEO will attempt to accommodate all Boarders and prospective Boarders to the extent possible, reasonable and practical. All stall and pipe corral assignments and/or changes must be approved in writing by CEO BEFORE such assignments and/or changes occur. Boarders and prospective Boarders may request, in writing, specific stall/pipe corral assignments. All such stall/pipe corral assignments shall be subject to approval by CEO. To the extent possible, reasonable and practical, from time-to-time, CEO will maintain, supervise and control a waiting list for each available stall and pipe corral. As such stalls and pipe corrals become available, and to the extent possible, reasonable and practical, Boarders and/or prospective Boarders will be offered such stalls/pipe corrals in the order of “first in time” on the waiting list, subject to, section 3 below. CEO however, reserves the right to override the “first-in time” intent at any time and award a stall or pipe corral to another person at its sole discretion. Unless such Boarder and/or prospective Boarder “then and there” accepts such available stall or pipe corral, it will be offered to the “next in line” on the waiting list. CEO assumes no responsibility, liability and/or fault with respect to the maintenance, supervision and control of such waiting list.
When a stall or pipe corral is given up by a trainer’s client at the Equestrian Preserve, that trainer shall have the first right to use<br> his or her client’s former stall/pipe corral;<br>however, the Boarding Agreement for that stall or pipe corral shall be in the client’s name if it is occupied by a client’s horse.
All horse trailers stored on the property must be registered with the Equestrian Preserve Office prior to entry upon the Equestrian Preserve premises, and shall be subject to a monthly parking and/or storage fee while on the premises. Failure to pay such parking and/or storage fee will result in the removal of the horse trailer from the Equestrian Preserve facility at Boarder’s expense.
The Equestrian Preserve premises shall not be used by anyone for the purpose of washing their motor vehicles.
No person shall bring any dog or other animal to the Equestrian Preserve (other than horses authorized to be on the premises as approved by CEO) unless the animal is physically restrained by the Boarder (which means that dogs must be on a leash at all times). Fines will be strictly enforced for dogs off leash. The first three times a dog is seen off leash, the owner will be charged a $50.00 fine for each incident. The fourth time the dog is seen off leash, the owner will no longer be allowed to bring the dog to the Equestrian Preserve. Under no circumstances will any such animals be allowed in the Equestrian Preserve’s arenas or lunging areas at any time.
Trainers who utilize the Equestrian Preserve facilities must be recognized by CEO, in writing, before providing any lessons, training and/or schooling services at the Equestrian Preserve. No person other than a trainer recognized by CEO or an agent or employee of such a trainer shall teach a Boarder or student guest at the Equestrian Preserve or train, ride, or exercise a Boarder’s horse for compensation. Failure to comply with this rule may result in the immediate revocation of both Boarder’s and the trainer’s privileges to use the Equestrian Preserve premises for any purpose.
Smoking is prohibited within twenty yards of any barns or stalls on the Equestrian Preserve premises. Violation of this rule shall result in immediate revocation of all privileges to use the Equestrian Preserve premises for any purpose. No alcoholic beverages may be consumed on the Equestrian Preserve premises by any Boarders, Boarders’ guests or student guests.
All riders on the Equestrian Preserve premises must wear an approved hard riding helmet at all times while jumping.
All riders under the age of eighteen (18) must be supervised by a competent adult at all times while riding or handling a horse, and must wear an approved hard riding helmet at all times while riding. In addition, regardless of whether the child is riding or handling a horse, all children under the age of twelve (12) must be supervised by an adult at all times while on the premises of the Equestrian Preserve.
At all times when riding, proper riding apparel must be worn by riders and all horses must be equipped with appropriate tack.
Horses on the Equestrian Preserve premises are not allowed to be loose, nor are they allowed to freely roam.
Except in arenas and schooling areas, all horses must be walked at all times on the premises.
Proper etiquette must be observed by all persons using the Equestrian Preserve facilities:
(a) Gates should remain closed or be closed behind the rider if other riders are present.(b) Pass left shoulder to left shoulder when riding.
(c) No person should obstruct the rail while riding, standing or talking.
No horse or other animal shall be abused or misused in any way upon the Equestrian Preserve premises or otherwise. Incidents of observed abuse or misuse must be reported to CEO, and may result in the immediate termination of a Boarder’s Boarding Agreement.
All persons using the Equestrian Preserve are responsible to clean-up after themselves and their animals, including when using the cross-ties and wash racks.
The following areas at the Equestrian Preserve are off-limits to Boarders, Boarder’s guests and student guests: the hay storage area, the work areas adjacent to the hay storage barn and the work areas in the trailer parking area, the bunkhouse, and shavings storage areas.
No hay shall be removed from the paddocks or feeders of other horses.
Turnouts shall not be used by any Boarder for more than one continuous thirty (30) minute period of time. All Boarders using the turnouts must be courteous and considerate of other Boarders waiting to use the turnouts. Other than the covered arena, no arena may be used as a turnout. When using the covered arena as a turnout, the horse must at all times be under the direct supervision of Boarder and/or a person authorized to turnout Boarder’s horse, and the horse must be removed from the covered arena when riders are present and waiting to use it. No turnouts are allowed at any time in the covered arena when any horse is being ridden in the dressage arena or the lower arena adjacent to Via Pajaro Road.
Horses must be properly supervised at all times when using the wash rack and cross-tie areas.
Lunging of horses shall be allowed only in the designated work or lunging areas and bullpens. From time-to-time, and in the sole discretion of CEO, the covered arena may be made available for such purposes during extremely inclement weather, but only when riders are not present. No “long lining,” “ponying” and/or “driving” of horses in any arena shall be allowed when riders are present.
Under no circumstances will illicit drugs or illegal controlled substances be allowed on the premises of the Equestrian Preserve at any time.
Stalls shall never be occupied by more than one horse at a time except that a mare and her foal may occupy a stall until weaning and/or until the foal reaches six (6) months of age, whichever comes first.
No mounting, dismounting and/or riding in barns at the Equestrian Preserve premises is allowed under any circumstances.
No motor vehicle shall be operated upon the Equestrian Preserve premises except upon designated roadways. No motor vehicles shall be operated at speeds exceeding five (5) miles per hour, and under no circumstances shall any person operate a motor vehicle, including a golf cart, without a valid driver’s license.
No horse on the Equestrian Preserve premises shall ever be lead from anything on wheels, whether motorized (e.g., golf carts, cars, trucks, tractors, mopeds, etc.) or not (e.g., bicycles, skateboards, etc.).
Bicycles shall not be ridden in any barns at the Equestrian Preserve facilities.
At no time will straw bedding be allowed on the premises except for mares in foal and only with prior approval by CEO.
No clinic, show and/or other event shall be permitted on Equestrian Preserve premises without prior written approval from CEO.
Any and all stall and/or pipe corral assignments must be approved in advance by CEO. No changing or switching of any stalls/pipe corrals is allowed for any reason without CEO’s approval and authorization, and unless otherwise approved by CEO, all such changes must occur on the first day of the month with the request for the change made the month before.
At no time will oat hay be permitted to be used at the Equestrian Preserve without the prior written approval of CEO. All supplements and grains are to be stored in approved rodent-proof and horse-proof containers, and if not, any such supplements or grains may be disposed of by CEO.
Any and all stall improvements, modifications, additions and/or “retrofitting” must be approved by CEO before being made, shall remain at the Equestrian Preserve facility at all times, and will be deemed the property of SBC immediately following installation and without reimbursement to Boarder. Boarder may be asked to remove such materials before Boarder’s security deposit will be returned. Upon approval of such improvements, modifications, additions, and/or “retrofitting,” such work may be performed by CEO. All expenses and charges for such approved work, or for restoring unapproved work, shall be billed to the Boarder for immediate payment.
Any and all added storage at the Equestrian Preserve premises must be approved by CEO in advance. In addition, all tack lockers, sheds and storage containers placed in front of or near stalls/pipe corrals must be approved by CEO, and CEO may require the removal of any unapproved tack lockers, sheds and storage containers.
Any and all trash dumpsters at the Equestrian Preserve are for the exclusive use of CEO and its employees.
Sub-leasing and/or dry stalling of stalls and pipe corrals must be approved by CEO and such arrangements are limited to a period of sixty (60) days. However, in its discretion, CEO may lengthen the period for sub-leasing and/or dry stalling of stalls/pipe corrals, and/or deny any sub-leasing and/or dry stalling arrangement.
If a Boarder already has a stall which is sub-leased to another person and/or dry stalled, no additional stall/pipe corral will be assigned to that Boarder from the waiting list.
To control water run off, and for proper drainage to the back portions of pipe corrals, no shavings may be used in the uncovered portions or the back half of the pipe stalls (regardless of the size or location of the pipe corrals). Only D.G. (decomposed granite) purchased through the Equestrian Preserve may be used in the back half of the pipe corrals. No outside trucking or delivery of the D.G. material to the Equestrian Preserve is allowed.
No person under the age of 18 years of age may ride or handle any stallion on the premises of the Equestrian Preserve, unless at all times when riding or handling the stallion, the minor is supervised by a trainer recognized by CEO.
CEO has the right to modify, amend, augment and/or otherwise supplement these rules and regulations from time-to time, and in the sole discretion of CEO, without prior notice to boarders, trainers and/or others using the Equestrian Preserve facility. All such amended Rules and Regulations will be maintained at the Equestrian C Preserve enter Office, and/or be mailed to the Boarder’s last known residence address.
